Foreigners guide to buying a condo in Thailand
Buying a condominium in Thailand as a foreigner is easy and straightforward. Foreigners can own condominiums anywhere in Thailand 100% outright, as long as the building has not already sold its 49% foreigner quota. When each condominium project is registered with the Land Department it designates 49% of its units for sale for potential purchase by a non-Thai buyer. If a unit is already owned by a foreigner (as a seller) it is straightforward for the unit to be sold on to another foreigner.
After you decided to purchase a condo unit and both parties agree the terms and conditions with a ‘sales agreement’ you will need to prepare all the appropriate documents to enable the transfer of ownership to take place with the Land Department as follows:
Buyer documents:
1. Copy of passport (signed)
2. Copy of the most recent visa that you entered Thailand on (signed)
3. Cash or cashiers cheque issued in the Seller’s name.
4. FET letter from the Bank in Thailand that received the money transferred from overseas showing the foreign currency exchanged into Thai Baht, (the amount must be equal to or above the purchase price).
5. If you want your spouse in the Title Deed then a copy of their passport and visa are also required.
6. Marriage certificate translated into Thai language.
7. If you do not want your spouse included in the title deed then a letter of consent from them will be required.
8. If the buyer is giving power of attorney to a third party then a signed the letter of power of attorney is required by the Land Department.
Note: all the above are usually prepared for you by the sales agent, however if you appoint a lawyer then they will prepare these for you. You will be instructed how many copies of these documents will be required.
Seller documents:
1. Copy of passport (signed).
2. Copy of the most recent visa that you entered Thailand on (signed).
3. Letter from the Juristic office that confirms the unit is free of debt.
4. Letter from Juristic office to confirm that the unit is within the foreigner quota or that the building has enough proportion of foreigner quota remaining. (2 copies of your passport & visa along with your signature are required to obtain this from the juristic office).
5. Title Deed (Original)
6. If your spouse is named in the Title deed then copies of their passport and visa are required.
7. Marriage certificate translated into Thai language.
8. If your spouse not included in the Title Deed then a letter of consent from them is required.
9. A letter of power of attorney from the Land Department if you are giving authorisation to a third party to do the transfer of ownership.
When the transfer of ownership is completed at the Land Department the Electricity Office must be informed of the change of name. The sales agent can complete this for you if you provide the following documents:
